In a federation letter to Elevance Health’s CEO, these organizations urge the company to immediately rescind its new facility administrative policy. They state that they are “dismayed that Anthem is attempting to bypass the negotiated bipartisan policy under the No Surprises Act that protects patients from surprise medical bills when out-of-network care is provided at an in-network hospital.” The organizations added that “this policy will impact patients’ access to care in multiple ways.”

Writing in a letter to Elevance Health’s CEO regarding Anthem’s new facility administrative policy, ASA, ACR, and ACEP state, “This policy is deeply flawed and operationally unworkable. It effectively shifts Elevance’s network adequacy obligations onto facilities, holding them financially liable for the contracting status of independent physician groups—an area over which they have no control or infrastructure to manage.”
